GRAVESEND: Motorist fined for using mobile while driving


A 30-year-old from Gravesend has been fined £60 and had three penalty points added to his licence after pleading guilty to using a mobile phone while driving.

James Lye, of Suffolk Road, was sentenced at Faversham and Sittingbourne Magistrates’ Court on March 2, after the court heard he used the phone on August 20 while driving in Tonbridge.

The offence is a CU80
(seems you don't have to be talking/texting on it just holding it is good enough for a conviction)
And insurance companies are apparenantly starting to decline insurance on CU80 convictions..

It would be easy to say never answer or make a call when on the move. Being human and open to temptation, that might be unlikely without further legislation being implemented.

Remember, making or receiving a call isn’t illegal, only using a handheld device is. Which is why hands-free kits make sense.

Actually there are so many people doing it, often at speed or negotiating traffic. It's cleary highly dangerous and if more drivers were prosecuted for using mobiles when on the move, maybe our roads would be a bit safer. Same goes for seat belts. Find 'em, fine 'em, stop 'em. By the way, I am a driver, I just want to see the roads safer for all

I have to ask what the difference is between, as you say, holding a phone and say operating a SatNav, or changing the radio station, or talking to the person next to you? I can't recall any convictions for these events?? I might be wrong of course!

It is confusing DrD, Being seen to use a hand-held phone is now a specific offence, that includes just holding the phone and not using it and carries the conviction code CU80.. Using a hands-free phone is not a specific offence, but provides grounds for a careless or dangerous driving prosecution in the event of erratic driving or an accident which is a DD40 or CD10.. So to me that says don't use the phone at all, even hands free..

The AA say radio and smoking don't carry convictions but a charge of careless driving, or not being in a position to control the vehicle becomes a distinct possibility. They can also be used to show dangerous driving, an offence which could lead to imprisonment, particularly if the dangerous driving causes a death..

You can use a Sat Nav, as long as you don't have to hold it, if you do it then comes under, using a hand held device ..And talking.. i have no idea..

I bet you any money that people like Andrew Wiley who thieve motors or drive like looneys cause more accidents than Joe Bloggs answering his phone. OB need to get their priorities sorted
